Terms and Conditions (EarlyNarratives)

These Terms and Conditions govern the services provided by MoorContent, a company registered in the Netherlands under Chamber of Commerce (KVK) number 65703103, trading as EarlyNarratives (“EarlyNarratives”, “we”, “us”). The Terms apply to all users of the EarlyNarratives platform and services.

1. Definitions

  • Services means the EarlyNarratives software, platform, websites, and related subscription services we provide.
  • Customer, you means any user, subscriber, or legal entity using or purchasing the Services.
  • Subscription means a paid recurring plan (monthly or annual) or other subscription term agreed with us.
  • Refund Policy means our refund policy available at: https://earlynarratives.com/refund (and on this site at /refund).

2. Scope and acceptance

By accessing or using the Services, creating an account, or purchasing a Subscription, you agree to these Terms. If you do not agree, do not use the Services.

If you use the Services on behalf of a company or other legal entity, you represent you have authority to bind that entity, and “you” includes that entity.

3. Subscriptions, billing, and renewal

  • Subscription fees, billing cycles, and included features are described at the point of purchase or in an order form.
  • Subscriptions generally renew automatically unless cancelled before the renewal date, as stated during checkout or in your plan settings.
  • You authorize us (and/or our payment partners) to charge the applicable recurring fees and taxes using your selected payment method.

4. Cancellation

You can cancel your Subscription in accordance with the cancellation options provided in the Services or by contacting us. Cancellation stops future renewals. Unless the Refund Policy applies, fees already paid are not refunded for the current billing period.

5. Customer rights and refunds (IMPORTANT)

Nothing in these Terms limits mandatory consumer rights under applicable law.

6. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We do not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements.

This section does not affect warranties that cannot be excluded under mandatory law.

7. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of revenue, data, or goodwill.
  • Our total liability for claims relating to the Services is limited to the amounts paid by you for the Services in the 12 months preceding the event giving rise to the claim (or such other cap as mandatory law requires).

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.

8. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict of laws principles. If you are a consumer, this does not deprive you of protections afforded by mandatory consumer laws of your country of residence.
